Net neutrality is the principle that internet service providers (ISPs) must treat all data on the internet equally, without discriminating or charging differently by user, content, website, platform, application, or method of communication. The term was coined by Columbia University media law professor Tim Wu in 2003, and the concept has become a central issue in telecommunications regulation worldwide. Proponents argue that net neutrality preserves a free and open internet, while opponents contend that it stifles investment and innovation in network infrastructure.
Net neutrality rests on the idea that the internet's value derives from its openness: any user can access any lawful content or service without interference from the network operator. The core principles include no blocking, no throttling, and no paid prioritization—meaning ISPs cannot degrade or favor specific traffic. The Federal Communications Commission (FCC) adopted these rules in 2015, classifying broadband as a telecommunications service under Title II of the Communications Act of 1934.1 Advocates argue that net neutrality protects free expression, competition, and innovation, citing examples like the success of startups that relied on equal access to users. The concept of 'zero-rating'—where ISPs offer free data for specific services—has been a contentious edge case, with some regulators allowing it and others banning it as a violation of neutrality. The term 'net neutrality' was popularized by Tim Wu, but similar ideas appeared earlier, such as in the 1990s 'end-to-end' principle of internet architecture. Also, net neutrality has implications for Internet of Things (IoT) devices, where discrimination could affect everything from smart home devices to autonomous vehicles. In 2020, the FCC under Chairman Pai also faced criticism for not enforcing net neutrality during the COVID-19 pandemic, when ISPs were asked to keep services accessible.7
